1. Introduction

Welcome to OpticsMedia Productions. These Terms of Service ("Terms") govern your access to and use of our photography services, website, and digital products (collectively, the "Services"). By booking a session, using our services, or accessing our website, you agree to be bound by these Terms.

Please read them carefully. If you do not agree to these Terms, you may not use the Services.

2. Services Offered

OpticsMedia Productions provides professional photography services, including but not limited to:

  • Portraits (individual, couples, family, etc.)

  • Sports Event Coverage (College, Highschool, Youth, Little League, ect.)

  • Events (weddings, parties, corporate events)

  • Commercial/Product Photography

  • Lifestyle & Branding Sessions

  • Image Editing and Retouching

  • Digital delivery of images

Custom packages may also be available upon request.

3. Booking & Payment

3.1 Booking

  • Bookings are confirmed upon receipt of a signed agreement and a non-refundable retainer (typically 25-50% of the total package price, as specified in your contract).

  • Scheduling is based on availability and is on a first-come, first-served basis.

  • Clients are responsible for providing accurate information and details regarding session requirements.

3.2 Payments

  • The remaining balance is due on or before the date of the photography session, unless otherwise specified in your invoice or agreement.

  • Payment methods accepted: [e.g., Credit Card, PayPal, Bank Transfer, Cash, etc.]

  • Late payments may incur a fee of $50 every 24 hours past due.

4. Cancellations & Rescheduling

4.1 Client Cancellation

  • Retainers are non-refundable under any circumstance.

  • If the Client cancels more than 5 days prior to the scheduled session, the session may be rescheduled once at no extra charge.

  • Cancellations within 4 days of the session may result in forfeiture of the retainer and/or additional fees.

4.2 Photographer Cancellation

  • In the unlikely event that OpticsMedia Productions must cancel a session due to illness, emergency, or unforeseen circumstances, efforts will be made to reschedule the session at no additional cost.

  • If rescheduling is not possible, any payments made (up to 50% of the retainer) will be fully refunded.

4.3 Weather & Location

  • Outdoor sessions may be rescheduled due to weather at the discretion of the photographer.

  • Location fees, permits, and travel expenses (if applicable) are the responsibility of the client unless stated otherwise.

5. Image Delivery

5.1 Turnaround Time

  • Standard turnaround time for galleries is 4-5 days from the session date.

  • Expedited delivery may be available for an additional fee.

5.2 Delivery Method

  • Images will be delivered digitally via an online gallery unless otherwise agreed.

  • Galleries will remain available for download for 2 Full Weeks (14 Days).

5.3 Image Quantity

  • The number of images delivered may vary depending on the package selected. No unedited or RAW files will be released unless specified in writing.

6. Editing & Retouching

  • All delivered images will be professionally edited in OpticsMedia Productions’ signature style.

  • Additional retouching requests (e.g., body modification, background changes) may incur extra fees.

  • Final image selection and editing decisions are at the sole discretion of the photographer.

7. Copyright & Usage

7.1 Copyright

  • All images are the intellectual property of OpticsMedia Productions and are protected under applicable copyright laws.

  • OpticsMedia Productions retains full copyright and ownership of all photographs, including those commissioned by clients.

7.2 Client Usage Rights

  • Clients receive a personal, non-transferable, non-commercial license to use and share the delivered images for personal use (e.g., printing, posting on social media).

  • Commercial usage (e.g., for marketing, advertising, or resale) requires a separate licensing agreement.

7.3 Photographer Usage Rights

  • OpticsMedia Productions reserves the right to use images for promotional purposes, portfolio display (online and print), social media, website, publications, and competitions unless otherwise agreed in writing.

8. Client Responsibilities

  • Clients are responsible for arriving on time, prepared, and appropriately dressed for their sessions.

  • Children and pets must be supervised at all times.

  • Clients agree to communicate clearly, respect the photographer’s creative direction, and maintain a professional relationship throughout the service engagement.

9. Limitations of Liability

  • OpticsMedia Productions is not liable for any damages arising from delays, loss of data, or service interruptions due to factors beyond our control (e.g., weather, equipment failure).

  • In the unlikely event of lost or damaged images, liability is limited to the return of all payments received or a reshoot, at the photographer’s discretion.

10. Privacy & Data

  • Client personal information (name, email, phone number, address) is collected solely for communication and service delivery.

  • Data is securely stored and will never be sold or shared without your consent, except where required by law.

11. Dispute Resolution

  • In the event of a dispute, both parties agree to attempt resolution through informal negotiation before pursuing legal action.

  • This agreement is governed by the laws of the State of Virginia.

12. Amendments

OpticsMedia Productions reserves the right to update or modify these Terms at any time. Clients will be notified of significant changes, and continued use of services implies agreement to the revised Terms.
